Introduction

  1. These terms of use (together with the other terms and policies referred to in it) apply to your use of the website threadsstyling.co.uk or www.threadsstyling.com (together the “Website”). Use of the Website includes accessing, browsing, or purchasing products through the Website.
  1. The Website is operated and provided by Threads Styling Ltd (“we”, “us”, “our”). We are a limited company. Our main trading address is Flat 4, 81 Curtain Road, London EC2A 3AG.

These terms of use refers to our privacy/cookies policy below, which also applies to your use of the Website and sets out information about the cookies on the Website and the terms on which we process any personal data we collect from you, or that you provide to us. By using the Website, you consent to such processing and you warrant that all data provided by you is accurate.
  1. If you purchase goods through the Website, paragraphs 7 to 14 will apply.
  1. We may change these terms of use, our privacy/cookies policy at any time by notifying you when you next access the Website. By continuing to use the Website after any such notification, you are expressly agreeing to such changes.

If you choose, or you are provided with, a user identification code, password or any other piece of information as part of our security procedures, you must treat such information as confidential. You must not disclose it to any third party and must take all reasonable steps to ensure that no unauthorised person shall have access to such information. We have the right to disable any user identification code or password, whether chosen by you or allocated by us, at any time, if in our reasonable opinion you have failed to comply with any of the provisions of these terms of use.

 

Description of our services and purchasing products

  1. We provide a service for you to purchase products through the Website from selected third party retailers and suppliers (“Retailers”). If you decide to purchase products from the Website, the resulting legal contract is between you and that Retailer. Such contract shall comprise of these terms (as applicable), the applicable details on the product page of the Website, the email confirmation of your order by Threads, the delivery information provided to you by the Retailer and any other applicable terms and conditions of the Retailer notified to you, and you agree to be bound by all such provisions. We are not a party to any such contract between you and the Retailer and you are not purchasing the products from us.
  1. By completing the check-out process and placing an order through the Website, you are offering to purchase the products from the relevant Retailer. To order products through the Website, you must be over 18 years of age and an authorised user of the method of payment used when placing your order. Once you have completed the check-out process, we will send you an email confirmation of your order, which shall include a description of the products ordered and we will forward your order to the Retailer. All orders are subject to availability and confirmation of the order price by the Retailer. The contract between you and the Retailer in relation to the products will not be formed until we have verified your payment details and checked that the Retailer accepts your order. If the Retailer accepts your order, the Retailer will send you a further email confirmation of your order, which shall include (amongst other things) the identity of the Retailer, the terms of delivery, information about your rights to cancel your order and the Retailer’s returns and refund policy. Each Retailer has their own processing times, delivery methods and prices, and returns and refund policies.
  1. Delivery costs are not included in the prices for the products. The delivery costs applicable to your order will vary depending on the identity of the Retailer from whom you are ordering the products, the products you have ordered, your delivery address and the delivery method.
  1. In order to process your order, we will need to share your personal data and delivery details that are related to such order with each of the Retailers from whom you are purchasing the products using our secure systems. The personal data and delivery details you provide to us will be collected, stored and processed in accordance with our Privacy Policyand Cookie Policy and in accordance with the privacy and cookies policies of the Retailers from whom you have purchased the products.
  1. The details, images and descriptions of the products that appear on the Website are provided to us by the Retailers. All efforts are made to ensure that such details, images, descriptions and prices are accurate, however your product may vary slightly from the images and descriptions provided.
  1. If the products you have ordered are not as described, flawed or not fit for purpose, you may return them to the Retailer in accordance with the Retailer’s returns policy and we shall assist you where reasonably practicable in respect of any such return, exchange or refund. Nothing in these terms affects your statutory rights in relation to products that are faulty or not as described.
  1. We do not review or control, and are not responsible in any way for, products sold by Retailers or the fulfilment of your orders and at no time do we possess any items offered for sale by Retailers through the Website. If you have any queries on the delivery of the products you have ordered, you may contact the Retailer directly and we shall assist you where reasonably practicable.
  1. We cannot give any undertaking that products you purchase from Retailers through the Website will be of satisfactory quality, and this and any other such warranties (whether express or implied) are disclaimed by us absolutely to the fullest extent permitted by law. This disclaimer does not affect your statutory rights against the Retailer.

 

Content-related provisions

  1. We, or our licensors, own all rights in the Website including all intellectual property rights.
  1. In consideration of you agreeing to abide by the terms of these terms of use, we grant you a non-transferable, non-exclusive licence to use the Website for your non-commercial use. We reserve all other rights.
  1. You agree not to: (i) copy any element of the Website; (ii) make alterations to, or modifications of, the whole or any part of the Website, or permit the Website or any part of it to be combined with, or become incorporated in, any other programs; (iii) use any element of the Website in any unlawful manner, for any unlawful purpose, or in any manner inconsistent with these terms of use, or act fraudulently or maliciously, for example, by hacking into or inserting malicious code, including viruses, or harmful data, in the Website; or (iv) infringe our intellectual property rights or those of any third party in relation to your use of the Website.

To the extent that the Website provides a platform for third party applications, websites and services (“Third Party Applications”) or links to third party websites (“Links”), you acknowledge and agree that we are not responsible for the features or content contained within, or made available to you by, any Third Party Application or Links.

 

Access to the Website

Whilst we endeavour to make the Website available 24 hours a day, we will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under these terms of use that is caused by any act or event beyond our reasonable control, including failure of public or private telecommunications networks.
  1. Access to the Website may be suspended or withdrawn or otherwise cancelled immediately at any time, and we may impose restrictions on the length and manner of usage of any part of the Website for any reason.

 

Liability

  1. The Website is provided “as is” and to the extent permitted by law, we exclude all conditions, warranties, representations or other terms which may apply to the Website, whether express or implied.

Nothing in these terms of use shall limit or exclude our liability for: (i) death or personal injury resulting from our negligence; (ii) our fraudulent misrepresentation; and (iii) any other liability that cannot be excluded or limited by English law. However, to the extent permitted by law: (a) without prejudice to your rights against the relevant Retailer, our maximum liability to you (whether in contract, tort, negligence, misrepresentation or under any other legal head of liability) in relation to your use or inability in use or delay in use of any element of the Website shall be limited to £1; and (b) we shall not have any liability to you (whether in contract, tort, negligence, misrepresentation or under any other legal head of liability) for any: (aa) indirect or consequential losses, damages, costs or expenses; (bb) loss of profits (whether direct or indirect); (cc) loss of reputation; or (dd) loss of, damage to or corruption of, data; in each case whether or not such losses were reasonably foreseeable or we had been advised of the possibility of you incurring such losses.

  1. These terms of use, their subject matter and their formation, are governed by English law. You and we both agree that the courts of England and Wales will have non-exclusive jurisdiction.

  1. Interpretation Capitalised terms used in this privacy/cookies policy and not defined herein, shall have the meanings given to them in the terms of use.

It may also be processed by staff operating outside the EEA who work for us or for one of our partners.
